1. Agreement and operator
By tapping Get Started, you agree to these Terms of Use and our Privacy Policy. These terms govern your use of Chatty Panda, developed and operated by Haikou Weiyao Technology Co., Ltd. (海口微曜科技有限公司). If you do not agree, do not use the service. You can use the app without creating an email-and-password account; an anonymous app account links your online learning records and subscription access.
2. What the service provides
Chatty Panda provides Mandarin learning activities, including AI conversations, speech playback, pronunciation assessment, learning notes, and progress features. The service is an educational aid, not a certified language examination, translator, or professional advisory service.
3. AI-generated content
AI responses, transcripts, translations, pronunciation results, and learning suggestions can be incomplete or inaccurate. Use reasonable judgment and do not rely on Chatty Panda for emergencies, legal matters, medical decisions, or other high-stakes situations.
4. Recordings and data use
Voice activities involve recording, storing, and processing your voice, transcripts, pronunciation results, and related data as described in our Privacy Policy. You grant us a worldwide, royalty-free, sublicensable, and transferable license to access, reproduce, store, process, modify, and create derivative materials from that data as reasonably needed to operate, maintain, develop, train, and improve Chatty Panda and related speech or learning technologies. This license is subject to applicable law and any permissions required for the particular use; it does not limit your statutory privacy rights.
By default, we may retain and use this data for product improvement and model training, subject to applicable law and any required permissions. We may also create de-identified datasets and derivative materials. Before treating them as anonymous, we take steps to remove account links, identifying metadata, and personal details in speech, and assess whether the remaining content or voice could reasonably identify a person. Removing an account identifier alone does not make a recording anonymous.
Data that no longer reasonably identifies a person may be retained, used, licensed, transferred, sold, disclosed, or otherwise commercialized with research, technology, and commercial partners for research, analytics, model training, product development, and other lawful business purposes. These uses may generate revenue for us. Data that remains identifiable continues to be handled as personal data under our Privacy Policy.
You are responsible for complying with applicable recording laws and obtaining any consent required before recording another person's voice. You can contact support@chattypanda.app about future product-improvement, model-training, or commercial data use, including to withdraw consent or object where applicable. Retention and deletion are explained in our Privacy Policy.
5. Your responsibilities
You agree not to misuse the service. In particular, you must not:
- Use the service unlawfully or to harm, threaten, or impersonate another person
- Attempt to bypass subscriptions, usage controls, security, or access restrictions
- Interfere with the service or use automated means that place unreasonable load on it
- Reverse engineer or redistribute protected parts of the app except where law permits
- Submit content that you do not have the right to use
6. Subscriptions and billing
Paid subscriptions are processed by Apple through the App Store. Prices, billing periods, trial or promotional terms, and renewal details are shown before purchase. Subscriptions renew automatically unless canceled according to Apple's rules. You can manage or cancel them in your Apple account settings. Refunds are handled under Apple's applicable policies.
7. Intellectual property
Chatty Panda, its visual design, software, learning content, and related materials belong to us or our licensors. These terms give you a limited, personal, non-transferable right to use the service; they do not transfer ownership of the service or its content.
8. Availability and changes
We may improve, modify, suspend, or discontinue parts of the service. AI and speech providers may also be temporarily unavailable. We aim to operate the service reliably but do not promise uninterrupted or error-free access.
9. Disclaimer and liability
To the extent permitted by applicable law, the service is provided on an “as available” basis. We are not liable for indirect, incidental, special, or consequential loss arising from use of the service. Nothing in these terms excludes rights or liability that cannot lawfully be excluded.
10. Suspension and termination
We may restrict or terminate access when reasonably necessary to protect users, the service, our providers, or legal compliance. You may stop using the service at any time; ending use does not automatically cancel an App Store subscription. Deleting your anonymous account and learning data also does not cancel that subscription; manage or cancel it in your Apple Account.
